We will promptly respond to valid notices of alleged copyright infringement that comply with the DMCA and other applicable laws, provided such notices are properly submitted to our designated DMCA agent. If you believe that any Content on our Service has been copied or used in a manner that constitutes copyright infringement, please submit a complete DMCA notification containing the following information:
-
A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the copyright owner;
-
Clear identification of the copyrighted work(s) claimed to have been infringed (e.g., title, author, publication date, and description of the copyrighted material);
-
Identification of the material on our Service that is claimed to be infringing or the subject of infringing activity, including information reasonably sufficient to permit us to locate the material (such as a specific URL, page title, or screenshot);
-
Your complete contact information, including your full name, physical address, telephone number, and a valid email address;
-
A written statement, signed by you (electronically or physically), that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law;
-
A statement, made under penalty of perjury, that the information contained in your notification is accurate, and that you are authorized to act on behalf of the copyright owner.
Counter-Notification Process
If you believe that your Content was removed or access to it was disabled in error (i.e., the Content is not infringing, or you have the necessary rights to post and use the Content), you may submit a counter-notification to our DMCA agent. Your counter-notification must include the following information:
-
Your physical or electronic signature (including your full legal name);
-
Clear identification of the Content that was removed or to which access was disabled, and the exact location where the Content appeared on our Service before it was removed or disabled (e.g., the original URL);
-
A statement, made under penalty of perjury, that you have a good faith belief that the Content was removed or disabled as a result of a mistake or misidentification of the Content;
-
Your full name, physical address, telephone number, and valid email address;
-
A statement that you consent to service of process from the person who submitted the original copyright infringement notification.
Upon receipt of a valid counter-notification, we may forward a copy of the counter-notification to the person who submitted the original infringement notice and inform them that we may restore the removed Content. Unless the original complainant files a legal action seeking a court order to prevent the restoration of the Content, we may, in our sole discretion, restore the removed Content within 10 to 14 business days (or longer, as appropriate) after receiving your counter-notification.
Important Notes
Please be advised that filing a counter-notification may result in legal proceedings between you and the complainant to determine ownership of the allegedly infringing Content. False or bad faith allegations (whether in a DMCA notification or counter-notification) may subject you to legal consequences under applicable law in your jurisdiction.
Fiercer.biz.id reserves the right, in our sole discretion and without prior notice, to remove any Content alleged to be infringing, in appropriate circumstances.
